Terms of Service

These terms govern the hosted Mako service at https://app.mako.ai and related clients (desktop, CLI, MCP server). The open-source code at https://github.com/mako-ai/mako is licensed separately under the MIT licence and is not subject to these terms.

1. The agreement

By creating an account or using the service you agree to these terms on behalf of yourself and, if you act for a company, that company (“you”). The service is provided by RealAdvisor SA, Route de Saint-Julien 198, 1228 Plan-les-Ouates, Switzerland, UID CHE-373.280.297 (“Mako”). Mako is a product of RealAdvisor. If you have a signed agreement with Mako, it prevails over these terms where they conflict.

2. Accounts and workspaces

  • You must be at least 18 and provide accurate information. Keep your credentials, API keys and agent grants confidential; you are responsible for activity under them.
  • A workspace admin controls who is a member, what they may access, and which agents and keys exist. Admins may remove members and revoke keys at any time.
  • You may connect only data sources you are authorised to access, and you are responsible for the lawfulness of the data you process with Mako.

3. Your data

You own your data: connections, queries, notebooks, dashboards, apps and results. You grant Mako the limited licence needed to store, process and display it in order to run the service for you, including sending the parts you choose to an AI model provider when you use the agent. We do not sell your data or use your database contents to train models. Our Privacy Policy describes processing in detail and forms part of these terms.

4. Acceptable use

You will not:

  • access data you are not entitled to, or attempt to defeat Mako’s read-only, scoping or rate-limiting controls;
  • use the service to build or run software that is unlawful, infringing, or harmful, or to store personal data you are not permitted to hold;
  • probe, scan or test the vulnerability of the service other than under our responsible-disclosure policy;
  • resell or provide the service to third parties as a standalone offering without our agreement;
  • use AI features to generate content that violates the model providers’ usage policies.

5. Plans, billing and changes

  • Paid plans are billed in advance by Stripe at the prices shown on the pricing page or in your order. Usage-based charges are billed in arrears.
  • Fees are exclusive of taxes. You may cancel at any time; the plan stays active until the end of the paid period and we do not refund partial periods except where the law requires.
  • We may change prices with 30 days’ notice, effective at your next renewal.
  • Free plans may be limited or changed at any time.

6. Published apps and sharing

When you publish an app, dashboard or share link, you decide who can see it. You are responsible for the content you publish and for the data it exposes. We may take down content that violates these terms or the law.

7. AI features

The agent writes queries and code from your instructions. Output can be wrong. You are responsible for reviewing results before relying on them, and for any actions you allow an agent to take. Where you connect your own agent through MCP, its provider’s terms also apply.

8. Availability and support

We aim for high availability but the service is provided without an uptime guarantee unless your plan or agreement includes one. Support is available at support@mako.ai and through the documentation.

9. Intellectual property

Mako and its logos are trademarks of RealAdvisor SA. The hosted service, including proprietary components not in the open-source repository, remains ours. Feedback you give us may be used without obligation.

10. Termination

You may close your account at any time. We may suspend or terminate access for material breach, non-payment, or legal risk, with notice where practicable. After termination you can export your data for 30 days; then we delete it as described in the Privacy Policy.

11. Warranties and liability

The service is provided “as is”. To the extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss, lost profits or lost data. Our total liability for any claim in a 12-month period is limited to the fees you paid in that period. Nothing limits liability for gross negligence, wilful misconduct or where the law does not allow limitation.

12. Governing law

These terms are governed by the laws of Switzerland. Disputes are subject to the exclusive jurisdiction of the courts of Geneva, Switzerland, without prejudice to mandatory consumer protections in your country.

13. Changes to these terms

We may update these terms; material changes are announced by email or in the app at least 14 days in advance. Continued use after the effective date is acceptance.
